The crash occurred even though Kaszuba was operating a 2014 Ford auto owned by Tesla either with the authorization of Tesla or whilst performing in his capability as a Tesla employee, Dugan alleged in his preliminary complaint.

Dugan had exited an Indianapolis gas station and was in the “ideal-hand targeted traffic lane” when Kaszuba, working the Tesla-owned Ford Super Obligation, “carelessly” drove the car across two lanes of visitors while attempting to switch into a parking lot near the fuel station, according to the complaint.

Kaszuba allegedly crashed the truck into Dugan’s motorcycle, throwing Dugan off the motorcycle and leading to Dugan to sustain devastating injuries, “a direct and proximate final result of the carelessness of the Defendants, Tesla, Inc., and Kyle Kaszuba,” per the complaint.

Tesla’s attorneys from Quinn Emanuel had argued that Kaszuba was not negligent in his steps and that Dugan was intently pursuing a motor vehicle that created it difficult for the Tesla worker to see him, according to Courtroom Perspective Community. An lawyer for Dugan, Nick Rowley, argued that Kaszuba was in a rush to get to work, in accordance to CVN.

The fuel station around where by the crash occurred is found just outside the house of a ramp to I-465, the ring road that encircles Indianapolis.
