SpaceX on Thursday sued a U.S. labor board that experienced accused the rocket and satellite maker of illegally firing staff members who sent a letter to corporation executives contacting CEO Elon Musk “a distraction and humiliation.”

SpaceX in the lawsuit submitted in Brownsville, Texas, federal courtroom promises the composition of the Nationwide Labor Relations Board, which issued a complaint towards the company on Wednesday, violates the U.S. Constitution.

The NLRB alleges SpaceX violated federal labor regulation by firing 8 employees in 2022 for signing onto the letter, which accused Musk of earning sexist responses that went from company insurance policies. That situation will be listened to by an administrative judge and then a five-member board appointed by the U.S. president. The board’s selections can be appealed in federal court docket.

But SpaceX in its lawsuit promises that since federal law only permits board associates and administrative judges to be eradicated for lead to, and not at will, the NLRB’s structure is unconstitutional.

The lawsuit seeks to block the NLRB case from moving ahead.

An NLRB spokeswoman declined to remark.
