The Netherlands on Friday introduced new export limits on sophisticated semiconductor products amid U.S. stress to slice China off from key chipmaking tools.

Businesses in the Netherlands will need to implement for a license to export specified state-of-the-art semiconductor production equipment overseas, the Dutch authorities reported, underneath guidelines that will come into impact on Sep. 1.

The Netherlands is home to ASML, a single of the most vital semiconductor companies in the globe. ASML would make equipment that is required to make the most innovative chips.

ASML shares ended up down 1.5% on Friday.

Previous Oct, the U.S. launched sweeping procedures aiming to lower off exports of essential chips and semiconductor equipment to China, a go analysts said could hobble Beijing’s ambitions to raise its domestic know-how. Given that then, the U.S. has been ramping up force on crucial chipmaking nations and allies like the Netherlands and Japan, to introduce export restrictions of their possess.

For the reason that of ASML’s critical job in advanced chips, Washington has sought to get the Netherlands on side. The Dutch government was on the fence but in March laid out limitations on the export of advanced semiconductor gear. Friday’s announcement finalizes these guidelines and offers far more clarity around what can and cannot be exported.

The legislation does not solitary out any state nor does it name ASML explicitly.

The Dutch governing administration said the policies apply to a “quantity of really certain technologies for the advancement and manufacture of state-of-the-art semiconductors,” that could perhaps be employed in areas like military programs.

“We’ve taken this move on countrywide protection grounds. It truly is good for the organizations that will be impacted to know what they can assume. This will give them the time they will need to adapt to the new rules,” Dutch Trade Minister Liesje Schreinemacher claimed in a statement.

ASML caught in the center

ASML’s machines are used by superior chip brands like TSMC. There are two key equipment it would make.

The initial is a so-called immersion deep ultraviolet (DUV) lithography device, which is used to manufacture memory chips. These chips are used in a myriad of equipment, from smartphones to laptops and servers, and could ultimately be applied for artificial intelligence apps.

The next is identified as an intense ultraviolet (EUV) lithography machine which is applied to make much more superior chips.

ASML explained it will now require to use for a license to export its most advanced immersion DUV lithography methods, termed the TWINSCAN NXT:2000i and subsequent applications.

The Dutch governing administration has employed a distinctive set of regulations to limit exports of ASML’s EUV equipment considering that 2018. EUV exports having said that will now occur under the regulation that arrives into influence in September.

ASML mentioned that it can commence distributing export licenses prior to the legislation comes into result and the governing administration will grant or deny these purposes on a situation-by-case foundation.

The corporation added that it does not hope the steps announced on Friday to have a content impression on its 2023 fiscal outlook.
